Terms of Service

The short version.Use Tapatize to help your group pick a place to eat, be decent to the people in your session, and understand the app is provided “as is.” The random pick is just for fun — where you actually eat is up to you.

1. Acceptance of these terms

These Terms of Service (“Terms”) govern your use of the Tapatize mobile app and website (together, the “Service”), provided by Tapatize (“we,” “us,” “our”). By accessing or using the Service, you agree to these Terms. If you don’t agree, please don’t use the Service.

2. What Tapatize is

Tapatize lets a group make a food decision together. One person starts a session and shares a QR code or link; participants join without an account and anonymously submit a food idea; the app then selects one idea at random and shows it to the group. The result is a suggestion for entertainment and convenience — it is not a recommendation, endorsement, or reservation, and you are responsible for your own dining choices.

3. Eligibility

You must be at least 13 years old to use the Service. If you are under the age of majority where you live, you may use the Service only with the involvement of a parent or guardian. By using the Service you represent that you meet these requirements.

4. No account; anonymous sessions

The Service does not require registration, and sessions are anonymous and temporary. You are responsible for anyone you invite to a session and for the content submitted from your device.

5. Acceptable use

When using the Service, you agree not to:

Submit content that is unlawful, harassing, hateful, threatening, obscene, or that infringes anyone’s rights;
Use the Service to harm, deceive, or abuse other participants;
Attempt to disrupt, overload, reverse engineer, or gain unauthorized access to the Service or its infrastructure;
Use automated means to flood, scrape, or manipulate sessions; or
Use the Service in violation of any applicable law or the rules of the app stores through which you obtained it.

6. User-submitted content

“Submissions” are the free-text food ideas you enter. You are solely responsible for your Submissions. Submissions are displayed anonymously to others in your session and are not attributed to you. Because sessions are short-lived and anonymous, we do not actively moderate Submissions; you use and view session content at your own discretion. You grant us a limited, temporary license to display and process your Submissions solely to operate the session in which they’re entered.

7. Availability & changes

We may modify, suspend, or discontinue any part of the Service at any time, and sessions may expire or be cleared as part of normal operation. We may also update, add, or remove features. We are not liable for any unavailability, lost session data, or interruption of the Service.

8. Intellectual property

The Service, including its name, branding (including the mark “Tapatize” and the phrase “Tap, Type, Submit”), design, and software, is owned by us and protected by applicable laws. These Terms do not grant you any right to use our branding without our prior written permission. You may use the Service only as permitted here.

9. Third-party services & app stores

The Service relies on third-party infrastructure (such as our hosting and realtime backend) and is distributed through the Apple App Store and Google Play. Your use of those platforms is subject to their terms. Where required, the app stores are third-party beneficiaries of these Terms and may enforce them against you; however, the app stores are not responsible for the Service or for support, which we provide.

10. Disclaimer of warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY RANDOM SELECTION WILL MEET YOUR EXPECTATIONS.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TAPATIZE AND ITS PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, GOODWILL, OR PROFITS, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100) OR THE AMOUNT YOU PAID US, IF ANY, IN THE PRECEDING TWELVE MONTHS, WHICHEVER IS GREATER.

12. Indemnification

You agree to indemnify and hold harmless Tapatize and its providers from any claims, damages, or expenses (including reasonable legal fees) arising out of your Submissions, your use of the Service, or your violation of these Terms or the rights of others.

13. Governing law

These Terms are governed by the laws of the United States and the State of [your state], without regard to conflict-of-law principles. Any dispute will be resolved in the courts located in that state, unless applicable law provides otherwise.

14. Changes to these Terms

We may update these Terms from time to time. When we do, we’ll revise the “Effective date” above and post the updated Terms here. Your continued use of the Service after changes take effect means you accept the revised Terms.
